Terms and Conditions That Control Booking a Trip with Himalayan Hero Adventures

These Terms & Conditions (hereafter "Terms") govern the relationship between Himalayan Hero Adventures Pvt. Ltd. and its clients. By booking a trip with us, you agree to be bound by these Terms.

1. Definitions

  • Company: Refers to Himalayan Hero Adventures Pvt. Ltd., a licensed Nepal trekking company registered with TAAN (Trekking Agencies' Association of Nepal) and NTB (Nepal Tourism Board).
  • Client: Refers to the individual(s), group, or entity making a booking and participating in a Trip organized by the Company.
  • Booking: Refers to the process of reserving a Trip with the Company, initiated by the Client completing and submitting the Booking Form.
  • Trip: Refers to any trekking, tour, or expedition package organized and offered by the Company.
  • Booking Form: Refers to the official document, either digital or physical, completed by the Client to provide necessary personal and trip-related information for a Booking.
  • Privacy Policy: Refers to the Company’s policy detailing the collection, use, and protection of Client personal data.

2. Booking & Reservations

To confirm a Booking, the Client must complete and submit the official Booking Form. A contract between the Company and the Client becomes legally binding only upon the Company's confirmation of the Booking after receiving the required deposit.

3. Payments & Deposit

A non-refundable deposit of 10% of the total Trip cost is required to secure your Booking, payable at least 30 days prior to the departure date for all Nepal trips. For Bhutan and Tibet trips, the balance is due 20 days prior to the departure date. For Nepal trips, the remaining balance of the Trip cost is due upon your arrival in Kathmandu.

4. Price Changes

All Trip rates are quoted in United States Dollars (USD). The Company reserves the right to adjust Trip prices in response to unforeseen circumstances, including but not limited to, significant currency fluctuations, the imposition of new government taxes or levies, or increased charges from third-party agents (e.g., airlines, hotels, local operators). Once your Booking is confirmed with the deposit, the price will generally be fixed, barring the aforementioned exceptional circumstances.

5. Last-Minute Bookings

The Company accepts last-minute Bookings for Nepal trips up to 3 days prior to the departure date, subject to availability. However, due to permit and logistical requirements, last-minute Bookings for Bhutan and Tibet trips are not accepted.

6. Cancellation & Refunds

  • The 10% deposit required for all Bookings is non-refundable.
  • For cancellations of Bhutan tours, a 20% cancellation fee of the total Trip cost will be applied.
  • For cancellations of Tibet tours, a 50% cancellation fee of the total Trip cost will be applied.
  • Clients may reschedule their Trip with at least 14 days' notice prior to the original departure date. In such cases, the initial 10% deposit can be transferred to the new Booking. Any price differences for the rescheduled Trip will apply.
  • Any other cancellations will be subject to a review and the Company's discretion.

7. Travel Insurance

Clients are required to obtain comprehensive travel insurance that covers medical expenses, personal accidents, and emergency helicopter evacuation, especially for altitudes above 2,500 meters. Proof of adequate insurance coverage must be presented to the Company upon your arrival in Kathmandu. Failure to provide proof of insurance may result in the cancellation of your Trip without refund.

8. Assumption of Risk & Liability

The Client acknowledges and voluntarily assumes all risks associated with participating in a Trip organized by the Company, including but not limited to, environmental hazards, accidents, illness, injury, or loss of personal property. The Company, its employees, agents, and affiliates shall not be liable for any loss, damage, accident, injury, illness, or death arising from participation in the Trip, or for any failures or omissions of third-party service providers (e.g., airlines, hotels, local transport). The Company reserves the right to modify Trip itineraries for the safety and well-being of the Client, without prior notice.

9. Incomplete Tours

No refunds will be provided for Trips that are cut short or altered by the Client for personal reasons, including but not limited to, illness, injury, family emergencies, or voluntary departure from the Trip.

10. Flight Delays & Cancellations

The Company is not liable for any flight delays, cancellations, or schedule changes, whether domestic or international, that may impact your Trip itinerary. We strongly recommend purchasing comprehensive travel insurance that covers such disruptions and planning extra buffer days in your travel schedule to mitigate potential issues.

11. Force Majeure

The Company shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is caused by events beyond its reasonable control, including but not limited to, natural disasters (earthquakes, landslides, floods), acts of God, war, civil unrest, political instability, strikes, epidemics, pandemics, or government restrictions (Force Majeure events). In the event of a Force Majeure event, the Company reserves the right to modify, postpone, or cancel the Trip. In such cases, the Client may be offered rescheduling options, or a refund minus any non-refundable expenses already incurred by the Company.

12. Privacy Policy

13. Updates to Terms

The Company reserves the right to amend or update these Terms at any time without prior notice. The most current version of these Terms will always be available on our official website. Your continued Booking or participation in a Trip after any such amendments constitutes your acceptance of the updated Terms.
